Routes to recovery

Confidential acquisition

We identify the registrant and negotiate without revealing your identity, within the budget you set. Often the fastest route when there is no obvious bad faith.

UDRP (Uniform Domain-Name Dispute-Resolution Policy)

ICANN’s official procedure before an arbitration centre (such as WIPO) for generic domains such as .com or .net, without going to court. It ends with the transfer of the domain to you.

URS (Uniform Rapid Suspension)

A very fast procedure designed for new gTLDs (new domains) in flagrant, clear-cut cases of trademark infringement. It ends with the immediate suspension of the domain.

ccTLD dispute policies

Country-code domains have their own out-of-court procedures, such as the Red.es policy for .es, which lets you regain control of the asset against abusive or bad-faith registrations through fast, binding arbitration.

What it takes to win a UDRP

  1. 1

    Identical or confusingly similar

The domain is identical or confusingly similar to your registered trademark.

  2. 2

    No legitimate interest

The registrant has no rights or legitimate interests in the name.

  3. 3

    Bad faith

The domain was registered and is being used in bad faith. For .es domains, bad faith in either registration or use is enough.

How we work

We assess the case before starting anything and recommend the route most likely to succeed. We prepare the documents and evidence, run the procedure and, where the case requires it, work with lawyers specialised in intellectual property.

No recovery can be guaranteed, but an honest assessment and handling that maximises the chances of success can.

Frequently asked questions

How long does a UDRP take?

Usually around two months from filing the complaint to the decision. The URS is faster.

Is buying the domain a better option?

It depends on the price the registrant asks and on the strength of the case. We give you both options with an estimated cost before you decide.

How is a UDRP complaint filed?

The complaint is filed with an ICANN-approved dispute resolution provider, such as the WIPO Arbitration and Mediation Center, with evidence of your trademark rights and of the registrant’s bad faith. We prepare the evidence and handle the filing for you.

Can you recover a domain that expired?

If it is still in its grace or redemption period, usually yes. If someone else has already registered it, we consider a purchase or a dispute procedure.
